Registration of Activities under the Aggregate Resources Act FormIndividuals or farming businesses that wish to excavate small amounts of aggregate from a pit on private land without a licence as per section 7(1.1) of the Aggregate Resources Act (ARA) must register the activity with the ministry using this form. All requirements set out in section 7.8 of Ontario Regulation (O. Reg) 244/97 must be met in order for a person to be eligible for this exemption. Only sites on private land, designated under Schedule 1 of O. Reg. 244/97, are eligible to register using this form. Aggregate excavation activities on Crown land are not eligible. Regardless of your eligibility for an exemption under the ARA, other legislation, policy or land use planning approvals may apply (e.g., Planning Act, Municipal Act, Endangered Species Act, Niagara Escarpment Planning and Development Act). It is your responsibility to ensure that you meet requirements and/or obtain appropriate approval(s) under other acts, regulations or policies. Records must be kept for the duration of the operation of the pit and for a period of seven years after the date on which rehabilitation is completed, and must include: 1) copies of all materials that were registered with the Minister and a municipality, 2) documentation demonstrating that all requirements of section 7.8 of O. Reg 244/97 have been satisfied, and 3) detailed records of the quantity and type of material removed from the pit. Any record must be produced for an inspector upon request. Pursuant to subsection 57(5) of the ARA. Note: All eligibility requirements and conditions set out in section 7.8 of Ontario Regulation 244/97 under the Aggregate Resources Act apply. Where there is a conflict between the requirements noted in this form and the regulation, the regulation shall prevail. Form should be submitted through the Natural Resources Information Portal (NRIP).
