the inspector or agent has inspected the animal and has reasonable grounds for believing that the animal is in distress and the owner or custodian of the animal is not present and cannot be found promptly; or
an order respecting the animal has been made under section 13 of the Ontario Society for the Prevention of Cruelty to Animals Act and the order has not been complied with.

And, the owner or custodian of the animal has been charged, in connection
with the same fact situation that gave rise to the removal pursuant to:

subsection 18.1 (1)(a) of the Ontario Society for the Prevention of Cruelty to Animals Act; or
subsection 18.1 (1)(b) of the Ontario Society for the Prevention of Cruelty to Animals Act; or
subsection 18.1 (1)(c) of the Ontario Society for the Prevention of Cruelty to Animals Act; or
subsection 18.1 (1)(d) of the Ontario Society for the Prevention of Cruelty to Animals Act; or
subsection 18.1 (1)(e) of the Ontario Society for the Prevention of Cruelty to Animals Act.

Based on the facts of this case and causes of distress to the animal I have reasonable grounds to believe that the animal may be harmed if returned to its owner or custodian.

My grounds for belief are:

I request that this Court make an Order authorizing the Ontario Society for the Prevention of Cruelty to Animals to keep the animal in its care for the duration of the court proceedings relating to this matter, as authorized by subsection 14 (1.1) of the Ontario Society for the Prevention of Cruelty to Animals Act.

I further request that the costs to the Ontario Society for the Prevention of Cruelty to Animals of providing food, care or treatment to the animal pursuant to its removal under subsection 14 (1) of the Ontario Society for the Prevention of Cruelty to Animals Act and pursuant to the order under subsection 14 (1.1) of the Ontario Society for the Prevention of Cruelty to Animals Act be paid by the owner or custodian of the animal to the Society, as authorized by subsection 14 (1.2) of the Ontario Society for the Prevention of Cruelty to Animals Act.

The costs of providing food, care or treatment to the animal pursuant to its removal are itemized in the attached Statement of Account.
